Domestic violence has a devastating physical, emotional and psychological affect on the domestic violence victims.  Oftentimes, domestic violence ends in murder.

 

So, What Will It Take To Stop Domestic Violence?

Laws Affecting Domestic Violence Must Be Changed And Enforced (Cont'd)

Here's an interesting portion of Tennessee law on domestic violence:

TCA 39-13-113

"(a)  It is an offense to knowingly violate:

     (1)  An order of protection issued pursuant to Title 36, Chapter 3, Part 6; "

"(d)  After a person has been arrested for a violation of this section, the arresting officer shall inform the victim that the person has been arrested and that such person may be eligible to post bond for the offense and be released until the date of trial for the offense."

Here is a portion of the terms and conditions that are printed on the standard Order of Protection form published on the internet by the State of Tennessee:

(Note:  The alleged victim is the "Petitioner" and the alleged abuser is the "Respondent".)

"THE COURT HEREBY ORDERS:
That the above named Respondent be restrained from committing further acts of abuse or threats of abuse against petitioner or petitioner’s minor children.  That the above named Respondent be restrained from any contact with the Petitioner/Plaintiff."

"IT IS FURTHER ORDERED AS FOLLOWS:
That the respondent shall not commit domestic abuse or threaten to commit domestic abuse against the petitioner or the
petitioners’ minor child(ren); or use or threaten physical force that would reasonably be expected to cause bodily injury; or
stalk the petitioner, as defined in T.CA. § 39-17-315."


"(X where applicable:)
The respondent is hereby ordered to refrain from telephoning, contacting, or otherwise communicating with the petitioner, directly or indirectly, or coming about petitioner or petitioner’s residence or place of employment for any purpose;"

First, we aren't quite sure how a person could "unknowingly" violate an Order of Protection, since a copy of the signed order is delivered to both the petitioner and the respondent.
