Domestic violence has a devastating physical, emotional and psychological affect on the domestic violence victims.  Oftentimes, domestic violence ends in murder.

 

So, What Will It Take To Stop Domestic Violence?

How does Tennessee punish alleged domestic violence abusers who violate an Order of Protection?

Prior to 2006, the maximum punishment for an alleged domestic violence abuser who violated an Order of Protection seems to have been 10 days in jail for each offense.

In 2006, Governor Bredesen signed a Bill changing the violation of an Order of Protection from a simple "contempt" charge to a "Class A Misdemeanor".  So, possibly some progress was made by the state of Tennessee in this area.

So, just what is a "Class A Misdemeanor" in Tennessee?

In Tennessee, contributing to the delinquency of a minor is a serious violation of the law. Any adult who aids or encourages a child to behave in an unruly manner or participate in delinquent activities is guilty of committing a Class A misdemeanor that may be tried in circuit or criminal court. A Class A misdemeanor is punishable by up to 11 months and 29 days in jail and fines up to $2,500.

In Tennessee, possession of Marijuana is a Class A Misdemeanor.

In Tennessee,  misrepresentation of academic credentials is a Class A misdemeanor.

In Tennessee, transporting or confining an animal in a cruel manner is a Class A misdemeanor.

Do you feel that someone who commits violent abusive acts against a woman and then violates a court order to stay away from the victim should receive the same punishment as someone who mistreats an animal?

 

Even if convicted of the violation of an Order of Protection, the alleged abuser can only get the maximum jail time of

11 months and 29 days for each offense.

Do you think that a person convicted of this offense would ever serve 100% of the maximum jail time?

How much jail time do you think this person would actually serve - 25%? 30%?
